Arora Medical Education Terms & Conditions

1. INTRODUCTION

 

These Terms and Conditions (“Terms”) govern your access to and use of the Arora Medical Education website, products and services.

 

By accessing our website, creating an account, purchasing a product or service, attending a course, participating in a mock examination or otherwise using any service provided by Arora Medical Education, you agree to be bound by these Terms.

 

If you do not agree with these Terms, you must not use our website, products or services.

Arora Medical Education is an independent educational provider and is not affiliated with, endorsed by or acting on behalf of the General Medical Council (GMC), NHS England, Royal College of General Practitioners (RCGP), UK Foundation Programme Office (UKFPO), General Practice National Recruitment Office (GPNRO), NHS Employers, Professional and Linguistic Assessments Board (PLAB), UK Medical Licensing Assessment (UKMLA) or any other examination or regulatory body unless expressly stated.

 

3. DEFINITIONS

 

In these Terms:

 

“Account” means a user account used to access products or services.

 

“Course” means any educational programme, workshop, revision event, mock examination, training session, webinar or educational activity provided by Arora Medical Education.

 

“Digital Content” means any content supplied electronically, including but not limited to videos, question banks, flashcards, mock examinations, audiobooks, downloadable resources and online learning materials.

 

“Live Course” means any educational activity delivered live, whether online or in person.

 

“User”, “Customer”, “You” or “Your” means any person accessing or using our products or services.

 

“Website” means aroramedicaleducation.co.uk and any associated learning platform operated by Arora Medical Education.

 

4. ACCEPTANCE OF THESE TERMS

 

By:

       – Accessing our website;

       – Creating an Account;

       – Purchasing a product or service;

       – Accessing Digital Content;

       – Attending a Live Course;

       – Participating in a mock examination; or

       – Using any service provided by Arora Medical Education,

 

you confirm that you have read, understood and agree to be bound by these Terms.

 

Where a booking or purchase is made on behalf of another person, the purchaser is responsible for ensuring that the participant complies with these Terms.

 

5. ELIGIBILITY

 

You must be at least 18 years of age or otherwise have legal capacity to enter into a legally binding agreement.

 

You are responsible for ensuring that all information provided to us is accurate, complete and up to date.

 

We may refuse access to products or services where we reasonably believe false, misleading or incomplete information has been provided.

 

6. USER ACCOUNTS

 

Certain products and services require the creation of an Account.

 

You are responsible for maintaining the confidentiality and security of your login credentials.

 

You must take reasonable steps to prevent unauthorised access to your Account.

 

You must notify us promptly if you become aware of:

       – Unauthorised access;

       – Security breaches;

       – Lost credentials; or

       – Suspected misuse of your Account.

 

You remain responsible for activity conducted through your Account unless and until you notify us of unauthorised use.

 

7. PRODUCTS AND SERVICES

 

Arora Medical Education provides educational products and services including, but not limited to:

       – Question banks;

       – Mock examinations;

       – Digital flashcards;

       – Audiobooks;

       – Revision programmes;

       – Live teaching courses;

       – Workshops;

       – Educational resources;

       – Healthcare professional training programmes.

 

Descriptions of products and services are provided on the relevant product pages.

 

We make reasonable efforts to ensure that descriptions, pricing and availability information are accurate.

 

However, we reserve the right to correct errors, inaccuracies or omissions where reasonably necessary.

 

8. ORDERS AND PAYMENTS

 

All orders are subject to acceptance by Arora Medical Education.

 

A contract is formed when:

       – Your order has been accepted; and

       – Payment has been successfully processed.

 

We reserve the right to refuse or cancel an order where we reasonably believe:

       – Payment cannot be processed;

       – Pricing errors have occurred;

       – Fraudulent activity is suspected;

       – Eligibility requirements are not met; or

       – Fulfilment would be inappropriate.

 

Where an order is cancelled before delivery of the product or service, any payment received will be refunded.

 

Prices displayed on our website may be amended from time to time.

 

Changes to pricing will not affect purchases already completed.

 

9. DIGITAL CONTENT

 

Many of our products are supplied as Digital Content.

 

Digital Content may include:

       – Online courses;

       – Video libraries;

       – Question banks;

       – Mock examinations;

       – Digital flashcards;

       – Audiobooks;

       – Downloadable resources;

       – Educational materials.

 

Digital Content is licensed, not sold.

 

Purchase of Digital Content grants you a limited right to access and use that content in accordance with these Terms.

 

Ownership of all intellectual property rights remains with Arora Medical Education and/or its licensors.

 

10. IMMEDIATE ACCESS TO DIGITAL CONTENT

 

Certain Digital Products are made available immediately following purchase.

 

Where immediate access is provided, customers may be required during checkout to:

       – Expressly request immediate access to the Digital Content; and

       – Acknowledge that statutory cancellation rights may be affected once access begins.

11. COURSE ACCESS PERIODS

 

Access periods vary between products.

 

The applicable access period will be displayed on the relevant product page at the time of purchase.

 

Access to Digital Content will normally expire automatically at the end of the applicable access period.

 

Users are responsible for ensuring that they utilise their access within the applicable access period.

 

12. ACCESS EXTENSIONS

 

From time to time, Arora Medical Education may choose to extend access to products or services.

 

Any extension of access is entirely discretionary.

 

The granting of an extension does not create any entitlement to future extensions.

 

We reserve the right to approve or decline extension requests.

 

13. LIVE COURSES AND LIVE EVENTS

 

This section applies to all Live Courses, workshops, webinars, revision sessions, mock examinations and educational events delivered online or in person.

 

We may deliver educational activities through:

       – In-person teaching;

       – Live online teaching;

       – Video conferencing platforms; or

       – Hybrid delivery formats.

 

We may make reasonable changes to:

       – Course schedules;

       – Teaching timetables;

       – Venues;

       – Faculty members;

       – Course formats;

       – Educational materials.

 

Such changes shall not constitute a breach of these Terms provided that the overall educational service remains substantially similar.

 

Attendance at a Live Course does not guarantee access to recordings, future sessions or additional teaching unless expressly stated.

 

14. COURSE FACULTY AND TUTOR SUBSTITUTIONS

 

We may substitute tutors, faculty members, presenters or course leads where reasonably necessary.

 

This may occur due to:

       – Illness;

       – Availability issues;

       – Operational requirements; or

       – Other reasonable circumstances.

 

Any substitute tutor or faculty member will be selected on the basis that they are reasonably capable of delivering the relevant educational content.

 

Such substitutions shall not constitute grounds for cancellation, refund or compensation.

 

15. RECORDINGS OF LIVE SESSIONS

 

Certain courses, workshops, mock examinations or educational events may be recorded.

 

Where recordings are made, participants may appear by:

       – Name;

       – Voice;

       – Video;

       – Screen sharing; or

       – Other forms of participation.

 

By participating in a recorded session, you consent to such recording and its use for educational, training, quality assurance and course delivery purposes.

 

Where recordings are provided to attendees, access shall be restricted to authorised users only.

 

Recordings may only be available for a limited period.

 

We reserve the right to remove, disable or delete recordings at any time following the applicable viewing period.

 

We are not obliged to record any session and do not guarantee that recordings will be available.

 

Users must not:

       – Record sessions without permission;

       – Copy recordings;

       – Download recordings unless expressly permitted;

       – Share recordings with third parties; or

       – Upload recordings to any website, platform or file-sharing service.

 

16. CERTIFICATES

 

Where certificates are offered, eligibility requirements will be determined by Arora Medical Education.

 

Certificates may be withheld where:

       – Attendance requirements have not been met;

       – Course requirements have not been completed;

       – Outstanding fees remain unpaid;

       – Account sharing has been identified;

       – Academic misconduct has occurred;

       – There has been a material breach of these Terms.

 

The issue of a certificate confirms participation only and does not represent:

       – Professional competence;

       – Regulatory approval;

       – Qualification for employment;

       – Eligibility for registration;

       – Examination success.

 

We reserve the right to amend, replace or discontinue certificates and certificate formats at any time.

 

17. INTELLECTUAL PROPERTY RIGHTS

 

All content made available by Arora Medical Education is protected by intellectual property laws.

 

This includes, but is not limited to:

       – Videos;

       – Question banks;

       – Mock examinations;

       – Digital flashcards;

       – Audiobooks;

       – Teaching slides;

       – Educational resources;

       – Case banks;

       – Written materials;

       – Course structures;

       – Educational frameworks;

       – Graphics;

       – Branding;

       – Logos;

       – Website content.

 

The structure, organisation, arrangement and selection of educational materials may also constitute protected intellectual property.

 

All intellectual property rights remain the exclusive property of Arora Medical Education and/or its licensors.

 

Purchase of a product or service does not transfer ownership of any intellectual property rights.

 

18. LICENCE TO USE CONTENT

 

Upon purchase, you are granted a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the relevant content solely for your own educational purposes.

 

You may not:

       – Reproduce content;

       – Redistribute content;

       – Sell content;

       – Resell content;

       – Licence content;

       – Publish content;

       – Share content;

       – Modify content;

       – Create derivative works from content;

       – Use content for commercial purposes;

 

unless expressly authorised in writing by Arora Medical Education.

 

19. ACCOUNT SHARING

 

Access to products and services is granted to one named individual only.

 

Accounts must not be shared with:

       – Friends;

       – Colleagues;

       – Family members;

       – Study groups;

       – Universities;

       – Hospitals;

       – Employers; or

       – Any other third party.

 

You must not provide your login credentials to any other person.

 

You are responsible for maintaining the confidentiality of your login credentials.

 

We may investigate suspected account sharing.

 

Where we reasonably believe account sharing has occurred, we may:

       – Suspend access;

       – Terminate access;

       – Withhold certificates;

       – Restrict future purchases;

       – Refuse future bookings;

       – Take further action permitted by law.

 

No refund will be provided where access is suspended or terminated due to account sharing.

 

20. ANTI-PIRACY AND CONTENT PROTECTION

 

Users must not:

       – Copy course materials;

       – Distribute course materials;

       – Share course materials;

       – Upload course materials to third-party platforms;

       – Upload course materials to file-sharing websites;

       – Upload course materials to social media;

       – Upload course materials to messaging platforms;

       – Sell course materials;

       – Resell course materials;

       – Make course materials available to unauthorised individuals.

 

This prohibition includes, but is not limited to sharing through:

       – Telegram;

       – WhatsApp;

       – Discord;

       – Facebook Groups;

       – Google Drive;

       – Dropbox;

       – OneDrive;

       – File-sharing websites;

       – Torrent services.

 

We reserve the right to investigate suspected breaches and take appropriate action including suspension, termination and legal enforcement.

 

21. ARTIFICIAL INTELLIGENCE AND AUTOMATED EXTRACTION

 

Users must not use content supplied by Arora Medical Education to:

       – Train artificial intelligence models;

       – Develop machine learning systems;

       – Create competing educational products;

       – Systematically extract educational content;

       – Populate third-party databases;

       – Facilitate automated scraping or extraction;

       – Reproduce substantial portions of our educational materials for redistribution or commercial use.

 

Nothing in this clause prevents reasonable personal use of artificial intelligence tools for private study purposes, provided that such use does not involve redistribution, commercial exploitation or infringement of our intellectual property rights.

 

22. USER CONDUCT AND ACCEPTABLE USE

 

Users must use our website, products and services lawfully, responsibly and respectfully.

 

Users must not:

       – Breach any applicable law or regulation;

       – Infringe the rights of any third party;

       – Attempt to gain unauthorised access to systems or accounts;

       – Introduce malicious software, viruses or harmful code;

       – Circumvent security measures;

       – Interfere with the operation of our website or learning platforms;

       – Misrepresent their identity;

       – Provide false information;

       – Engage in academic misconduct;

       – Use our services in a manner likely to damage the reputation of Arora Medical Education.

 

Users must also comply with our Acceptable Use Policy.

 

23. ABUSIVE OR INAPPROPRIATE BEHAVIOUR

 

We are committed to providing a safe and professional learning environment for all users, faculty members, staff and participants.

 

We do not tolerate:

       – Harassment;

       – Bullying;

       – Threatening behaviour;

       – Intimidation;

       – Discriminatory conduct;

       – Offensive communications;

       – Abusive emails;

       – Abusive messages;

       – Abusive social media activity directed towards our staff, faculty members or users.

 

Where we reasonably believe such behaviour has occurred, we may:

       – Suspend access;

       – Remove a participant from a course;

       – Terminate an account;

       – Refuse future bookings;

       – Report matters to relevant authorities where appropriate.

 

No refund will be due where action is taken as a result of behaviour that breaches these Terms.

 

24. USER-GENERATED CONTENT

 

Certain services may allow users to submit, upload, post or otherwise provide content.

 

This may include:

       – Comments;

       – Discussion posts;

       – Messages;

       – Assignments;

       – Feedback;

       – Uploaded materials.

 

Users remain responsible for any content they submit.

 

Users must not submit content that:

       – Is unlawful;

       – Is defamatory;

       – Is abusive;

       – Is discriminatory;

       – Infringes intellectual property rights;

       – Violates privacy rights;

       – Contains malicious software;

       – Is misleading or fraudulent.

 

By submitting content, users grant Arora Medical Education a non-exclusive, worldwide, royalty-free licence to use, reproduce, store and display such content for the purposes of operating, maintaining and improving our services.

 

We reserve the right to moderate, edit, remove or refuse content where reasonably necessary.

 

25. EXAMINATION PREPARATION DISCLAIMER

 

Arora Medical Education provides educational resources designed to support learning and examination preparation.

 

We make reasonable efforts to ensure that content is accurate and educationally valuable.

 

However, we do not guarantee:

       – Examination success;

       – Passing scores;

       – GMC registration;

       – Entry into training programmes;

       – Employment opportunities;

       – Professional progression;

       – Achievement of any particular outcome.

 

Examination performance depends upon numerous factors beyond our control, including a candidate’s preparation, knowledge, skills, experience and performance on the day of the examination.

 

Users remain solely responsible for their own preparation and examination performance.

 

26. CLINICAL DISCLAIMER

 

All educational content provided by Arora Medical Education is supplied for educational purposes only.

 

Our content is not intended to constitute:

       – Clinical advice;

       – Medical advice;

       – Treatment recommendations;

       – Patient-specific guidance;

       – Legal advice;

       – Regulatory advice.

 

Users remain solely responsible for exercising their own professional judgement and complying with:

       – Applicable laws;

       – Professional standards;

       – Regulatory requirements;

       – Local policies;

       – Local guidelines;

       – Employer requirements.

 

Arora Medical Education accepts no responsibility for clinical decisions, patient outcomes or professional actions taken by users.

 

27. SUSPENSION AND TERMINATION

 

We may suspend or terminate access to our products or services where we reasonably believe that a user has:

       – Breached these Terms;

       – Breached the Refund Policy;

       – Breached the Acceptable Use Policy;

       – Shared account credentials;

       – Infringed intellectual property rights;

       – Engaged in piracy;

       – Engaged in abusive behaviour;

       – Initiated a fraudulent payment dispute;

       – Misused our services;

       – Acted in a way likely to cause harm to Arora Medical Education, our staff or our users.

 

Where appropriate, we may investigate suspected breaches before taking action.

 

Suspension or termination under this section shall not create any entitlement to a refund.

 

28. LIMITATION OF LIABILITY

 

Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful.

 

This includes liability for:

       – Death or personal injury caused by negligence;

       – Fraud or fraudulent misrepresentation; or

       – Any liability that cannot legally be excluded or limited.

 

Subject to the above, Arora Medical Education shall not be liable for:

       – Indirect losses;

       – Consequential losses;

       – Loss of profits;

       – Loss of earnings;

       – Loss of business opportunities;

       – Loss of goodwill;

       – Loss of data;

       – Examination failure;

       – Failure to obtain registration;

       – Failure to obtain employment;

       – Failure to obtain training progression;

       – Failure to achieve any professional or educational outcome.

 

Subject to applicable law, our total liability arising from any claim connected with a product or service shall not exceed the amount paid by the user for that product or service.

 

29. FORCE MAJEURE

 

We shall not be responsible for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control.

 

Such events may include:

       – Serious illness;

       – Technical failures;

       – Internet outages;

       – Utility failures;

       – Venue closures;

       – Industrial action;

       – Severe weather;

       – Natural disasters;

       – Government action;

       – Public health emergencies;

       – Civil unrest.

 

Where reasonably possible, we will seek to provide an alternative date, alternative format or other suitable solution.

 

30. CHANGES TO SERVICES

 

We continually review and improve our products and services.

 

We may:

       – Update content;

       – Revise educational materials;

       – Modify question banks;

       – Update flashcards;

       – Update videos;

       – Improve course structures;

       – Change faculty members;

       – Change venues;

       – Change schedules;

Such changes shall not constitute a breach of contract provided that the overall educational service remains substantially similar.

 

31. PRIVACY

 

The collection and use of personal information is governed by our Privacy Policy.

 

By using our services, you acknowledge that personal information may be processed in accordance with that policy.

 

32. SEVERABILITY

 

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions shall continue in full force and effect.

 

33. ENTIRE AGREEMENT

 

These Terms, together with our Refund Policy, Privacy Policy, Cookie Policy and Acceptable Use Policy, constitute the entire agreement between Arora Medical Education and the user in relation to the products and services supplied.

 

34. GOVERNING LAW AND JURISDICTION

 

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

 

Any dispute arising from or connected with these Terms, our products or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

 

Nothing in these Terms affects any mandatory rights that cannot legally be excluded under applicable consumer protection laws.
